These conditions are an agreement between parties. Any infringement permits the Agent or Owner to refuse a key, amend the rental and/or terminate the booking/occupancy without refund. Variances can be agreed on but only by arrangement with the owner in writing.
UNDER THE PRIVACY ACT 2000 WE ARE REQUIRED TO HAVE THE FOLLOWING PRIVACY COLLECTION NOTICE AGREED TO FOR ALL HOLIDAY GUESTS. BY TICKING THE BOX YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS.
We welcome you to view the property prior to booking either in person or on our website www.phillipisland.com.au
. Upon booking, the guest hereby accept the premises as acceptable and cannot be relocated.
With regard to telephone bookings we accept no responsibility for mis-description.
A Booking fee (GST Inclusive) applies to all bookings taken by Judith Wright Stockdale & Leggo Real Estate for holiday accommodation. This booking fee is NON refundable and additional to the rental accommodation charge and has been included in your fee.
Bookings are accepted by us in good faith as marketing and booking agents for the property owners. We cannot be held responsible for actions taken by the owner of the premises or other occurrences that are outside of our control such as if:
• The tariff is increased prior to your occupation
• The owner sells their property
• The property is altered in any way
• Malfunction of any inventory articles
• The property is withdrawn from letting
• Owner declines booking
Should any of the above occur every reasonable endeavour will be made to find alternative accommodation.
We accept no responsibility for mis-description of the property, particularly with regard to telephone bookings. We cordially invite you to view the property prior to confirming your booking.
A 50% non-refundable deposit and any booking fees are required to confirm your booking and will be deducted from your supplied credit card details at the time of the booking being made for some properties, other properties may allow up to 7 days for you to make a deposit payment. Payment of the rental deposit constitutes the clients acceptance of these Terms & Conditions and the card saving policy. The balance of the total booking will be deducted in full from your supplied credit card details approximately 30 days prior to occupancy. If this time has already lapsed, full payment will be required at the time of booking. A 1% surcharge will apply to all credit card payments and only Visa and Mastercard are accepted. It is a condition of this agreement that the guest provide security for their occupation. When paying online via credit card this means that you have accepted these terms and conditions and our card saving policy. For all other bookings we require a signed copy of these terms and conditions along with credit card details, a copy of your driver’s licence and/or cash security bond in the amount advised by us to be received in clear funds with payment of your balance amount. Failure to supply these promptly may result in your booking being cancelled. Unauthorized cancellations or withdrawal of a bond may constitute an act of fraud.
Keys will not be made available until ALL monies have been paid in full. Arrangements for the collection of keys outside of office hours should be made prior to arrival. Keys must be returned to our Cowes office (or key safe at the property if specified) upon departure. If keys are not returned to us, a key collection fee of $22 will apply and will be deducted from your supplied credit card details including a 1% surcharge.
Cancellation if caused by the client - money paid is not refundable unless the house is re-let for the entire period. If a refund is made, due to the property being re-let then a $50 cancellation fee will apply and the booking fee is non refundable. Under no circumstances will refunds apply for early departure or refusal to stay at a booked property.
Arrival and Departure Times
All keys may be picked up from 2:00pm and must be returned to our office at 52 Thompson Avenue, Cowes (or to the key safe at the property if applicable to your stay). Departure is by 10.00am so that the cleaner is able to access the property for cleaning, please return the key to the office (or key safe if applicable to your stay) by 10:30am on the morning of your departure. Additional charges may apply if you fail to check-out on time.
It is the guest’s responsibility to advise our office if they will be late or have been delayed during business hours to arrange alternate key collection. The Agent cannot be responsible for alternate accommodation or any other costs when guests arrive after hours if no prior arrangement has been made.
Metre Box Drops
This is an after-hours service ONLY. We do acknowledge that it is necessary, especially with international guest’s flights arriving after business hours and public holidays, but it is not a service we offer within business hours and a $22 fee will apply.
Our phones are always diverted to the after hour’s phone. Please be aware that this is for emergency calls ONLY, and any unnecessary call outs will incur a $55 (inc GST) cash fee, this will be deducted from the supplied credit card details and will include a 1% surcharge.
Most properties are let WITHOUT LINEN unless specified otherwise on the property listing. Guests must supply their own sheets, pillowslips, towels, bath mats & tea towels. Linen is supplied for all properties for the Motorcycle GP & Super Bikes Only. Linen hire is available through Glenda Binch, please call her on 0428 170 117, should you require this service.
As the guest you are responsible for any damages, breakages or loss incurred during the term of your occupancy which will be deducted from your supplied credit card details including a 1% surcharge. These are to be reported as soon as it occurs and/ or replaced and paid for.
Under instruction from our owners we are unable to accept schoolies bookings as we do not have the policies, procedures or resources to accommodate these bookings
Please note all holiday properties are Non Smoking. No cigarette butts are to be left on the ground.
Pets are not allowed unless you have booked a specified pet friendly property. Upon your departure you must ensure that the property is found to have no trace of the pet(s) left behind both inside and outside, otherwise the cost for additional cleaning will be deducted from your supplied credit card details plus a 1% surcharge.
It is a condition of your stay to return the property to the same conditions as it was when you arrived.
You are staying in someone’s house - Please leave the premises clean and tidy, with cutlery and cooking utensils washed and put away, beds made and in the same condition as it was presented on arrival. Additional cleaning fees will be charged to your supplied credit card details (plus a 1% surcharge) to return the property to its prior condition. A fee of approximately $50 or more may apply. If, upon occupation, the property or contents failed to meet acceptable cleaning standards every endeavour will be made to rectify the problem, you are required to contact our office immediately so we can do so. This shall not constitute grounds for cancellation or refund.

Accommodating extra persons
Setting up makeshift structures i.e. tents or caravans and accommodating more persons than the property permits is prohibited.
Parties and functions are strictly prohibited
The price charged is for domestic use only and not commercial. Accordingly this rate does not allow for the extra wear associated with functions in terms of cleaning, garbage removal, wear and tear, repairs etc. Use contrary to this may result in loss of your bond and/or additional payments deducted from your supplied credit card details.
The Agent reserves the right to resolve any dispute on behalf of all the involved parties.
You, the Guest, indemnify the agency against any liability which may attach to the agency as a result of damage, injury, loss or inconvenience being personal or proprietary suffered by any person where damage, injury or loss has been contributed to or caused by any act or occasion of the tenant or his visitor. These conditions are an agreement between the parties. Any infringement of the above conditions permits the agency to refuse a key, amend the rental or immediately terminate the booked stay.
The Guest must vacate the premises upon demand of the Agent or Owner without refund upon breach of this agreement. Infringements include incorrect information supplied to the agency upon booking the property, causing malicious damage to the property being/causing a public nuisance, excess noise, accommodating more persons than agreed, parties or setting up makeshift structures or ignoring warnings or requests from the agent.
The Agent or Landlord can make an inspection of the premises upon demand.
It is a breach of council regulations to light fires in the open at any times – Fines apply.
The Bass Coast Council bylaws state that loud noise cannot occur outside the following hours:
Monday – Thursday 7am – 10pm Friday 7am – 11pm
Saturday & Public Holidays 9am – 11pm Sunday 9am – 10pm
All properties are located in residential areas and the agency asks that the tenants are considerate regarding noise after the legal requirement.
There are two bins provided one for recycling and one for household waste. Please use appropriately. The bin is to be put out for Council collection during the week and when you bring it in, line it with the rubbish bag provided and pull to the front of the property on departure. Please take any excess rubbish to the tip or anything left at the property will incur a removal fee between $55.00 to $100 approximately, depending on the amount of rubbish needing to be removed.
Lost & Forgotten Items
Please check carefully before you leave the property as we cannot guarantee any items left in properties will be found and returned to you. If at any time you request us to return to the property to check for lost items, there will be a minimum cost of $30 for collection and postage charges. Payment via credit card will incur a 1% credit card Surcharge. All lost items will only be held at our office for 1 (one) Month.
Bad Books Register
Judith Wright Stockdale & Leggo Real Estate participates in the Bad Books register. By accepting this booking you hereby agree that if you or any occupant covered by this booking, including any guests, breach our Terms and Conditions then your Name, Phone Number and Email address along with details of the breach/breaches may be disclosed to the property landlord and/or other agents participating in the Bad Books register. Judith Wright Stockdale & Leggo Real Estate reserves the right to cancel a booking where a guest is already in the Bad Books register.
Privacy Act 2000
The personal information the Guest provides or that which is collected from other sources is necessary for the Agent to verify the Applicants identity, process and contact guest. The personal information collected about the Guest may be disclosed for the purpose for which it was collected to other parties including the Landlord, our staff, our cleaners or contractors if a problem arises, the police (if a problem arises), referees, financial institutions, other agents, third party operators of tenancy reference databases and other third parties as required by law. Information already held on tenancy reference databases may also be disclosed to the Agent or Landlord.
If the Guest would like to access his/her personal information held by the Agent, they can do so by contacting the Agent at 52 Thompson Avenue Cowes 3922. The Guest can also correct this information if it is inaccurate incomplete or out of date.
By accepting the terms and conditions, I acknowledge that I have read and understand the above statement and consent to my personal information being forwarded to the above when necessary.
CONDITIONS OF BOOKING
The person agreeing to this document and/or actually occupying the accommodation or utilising outlined services agrees to be bound by and accept the Terms & Conditions outlined upon payment of deposit.
hereby authorise Judith Wright Stockdale & Leggo Phillip Island Real Estate to retain the credit card details supplied as security over the booking/property. As the guest you are fully responsible for all damages/losses/additional cleaning, rubbish removal/lost keys, additional persons/admin fees etc. that are incurred during our stay caused by any person residing at the premises during the booked period which I understand will be deducted from my credit card.
PLEASE NOTE: If the matter is placed in the hands of debt collectors, all costs incurred due to recovery of monies, will be the responsibility of the person in question.
THE PROPERTY IS EXPECTED TO BE RETURNED AS IT WAS FOUND. FAILURE TO DO SO WILL RESULT IN CHARGES TO YOUR ACCOUNT. PLEASE ADVISE OUR OFFICE IMMEDIATELY UPON ARRIVAL SHOULD YOU IDENTIFY ANY ISSUES SO WE CAN CHARGE THE PREVIOUS BOOKING ACCORDINGLY. FAILURE TO DO SO WILL RESULT IN THE ISSUES BEING CHARGED TO YOUR BOOKING.
RUBBISH –depending on the bin collection day at the property there may be some rubbish present in the bins. Please advise our office immediately upon arrival if there is excessive rubbish present from prior guests. Failure to report excess rubbish immediately may result in the charge being allocated to your account. Guests are responsible for the removal of any excess rubbish that cannot be contained completely in the bins provided. Staff can advise you which day bins are emptied by council and we appreciate guest putting the bins out for collection. Failure to remove excess rubbish will result in a charge to the guest of between $55 and $100 approximately.
BBQ –a BBQ may be provided at the property for your use. Please ensure the BBQ and utensils are left cleaned upon departure. Failure to comply will result in a minimum charge to the guest of $50.
OVEN & FRIDGE – Please clean any spills etc. that may occur. Failure to leave these items clean will result in a minimum charge of $40.
DISHES & KITCHEN – please leave these areas clean and free of dishes. Failure to do so will result in a minimum charge of $40.
BATHROOMS & TOILETS – Please leave these areas clean. Failure to do so will result in a minimum charge of $40.
GAS BOTTLES (bbq) – should the gas bottle run out of gas you will be reimbursed the cost of swap & go upon providing us with a receipt. Some properties do have a spare bottle onsite – please call our office for confirmation.
THESE MEASURES ARE TAKEN TO ENSURE A CLEAN AND COMFORTABLE STAY FOR ALL GUESTS. THEREFORE IT IS IMPERATIVE THAT YOU CONTACT OUR OFFICE IMMEDIATELY UPON ARRIVAL SHOULD YOU NOTE ANY ISSUES AS LISTED ABOVE THAT NEED TO BE CHARGED TO THE PREVIOUS GUEST.
SHOULD ANY ISSUES BE PRESENT – DO NOT RECTIFY – We will send a representative to complete the task and charge the previous guest accordingly. Therefore the current guest will still be required to comply with the above conditions upon departure.
By agreeing to these terms and conditions you acknowledge that you will be liable for any additional costs incurred during your stay which will be deducted from the supplied credit card details.

Card Saving Policy Acceptance..
Judith Wright Stockdaloe and Leggo reserve the right to further charge the credit card to recover reasonable costs for any of the following caused during your stay;
